Faulty Airbags Lawsuit – History

Dating back to the 1970’s when American car manufacturers began assembling airbags into vehicles, injuries (and even death) caused by defects gained government attention. In 1977, the U.S. Department of Transportation (under Brock Adams during President Carter’s administration) mandated that by September 1st, 1983 all newly manufactured automobiles must have passive restraint systems after automatic seatbelts (AKA Passive Seatbelts) and Airbags became standard. In 1998, The National Highway Traffic Safety Administration, or NHTSA, mandated that every vehicle must have dual front airbags, saving thousands in traffic accidents according to federal statistics.

Airbag Failure to Deploy

Airbags can, and do, fail to properly function. They can deploy by mistake, activate during a non-collision, or fail to fully trigger when an accident does occur. Because of this, those in the vehicle during a collision when an airbag does not deploy can be seriously injured (or killed). The NHTSA statistics showed from 1990 to 2007, over two-hundred and fifty Americans, including children, died due to airbag defects as well as thousands of non-fatal injuries. Younger children are especially vulnerable to injuries when airbags deploy, even when they perform properly.
